Jennifer J. Miller

Senior Associate

    Jennifer works primarily in the area of litigation, including business, employment, public interest and other cases.  Her varied litigation experience includes over 20 appellate cases and includes both state and federal courts.  Jennifer also assists clients in both federal and state trials.

     

     

     

     

    Representative Matters

    • Both successfully securing and resisting preliminary and permanent injunctive relief.
    • Successfully prosecuting and defending appeals of cases in the South Carolina Supreme Court, the South Carolina Court of Appeals, and the U.S. Court of Appeals for the Fourth Circuit.
    • Assisted in obtaining South Carolina Supreme Court ruling that an Act of the General Assembly violated the South Carolina Constitution’s requirement that every law passed by the state legislature pertain to only one subject. 
    • Assisted in obtaining South Carolina Supreme Court ruling that no-bid procurement contracts by the South Carolina Department of Transportation were unlawful.
    • Assisted in obtaining South Carolina Supreme Court ruling that Department of Transportation Commissioners could not serve more than one consecutive term, resulting in Commissioners’ resignations.
    • Assisted in obtaining South Carolina Supreme Court ruling that the Department of Transportation erred when it allowed a no-bid “emergency” procurement for a road-widening project. 
    • Assisted in obtaining several Circuit Court rulings requiring government officials to comply with Freedom of Information Act requests.
    • Assisted in obtaining awards of attorney’s fees and costs in several public interest cases at both the trial and appellate level.
